Refund and Return Policy

1. Scope of Application

This refund and return policy applies to all services offered by Winkel Factuur ("we", "us", "the service"), a trading name of [Company Name], registered in the Netherlands.
By using our services, you agree to this policy. This policy forms an integral part of our Terms and Conditions.

2. Nature of the Service

Winkel Factuur provides digital services in the form of:
• Automated invoice creation and delivery
• Software-as-a-Service (SaaS) solutions
• API integrations with e-commerce platforms
• Digital reporting and analytics
Our services are delivered electronically immediately upon activation and are of a digital nature without physical carrier.

3. Consumer Right of Withdrawal (Legal Basis)

In accordance with the European Consumer Rights Directive (2011/83/EU), consumers generally have a right of withdrawal of 14 days.
3.1 Exception to Right of Withdrawal
However, the right of withdrawal explicitly expires when:
Digital services whose performance has begun with your express prior consent (Article 16(m) of the Directive)
Services that have been fully performed before the withdrawal period has expired
3.2 Your Consent
By activating a subscription or completing a payment, you give express consent to:
1. Immediately access the service
2. Directly use the full functionality
3. Waive your right of withdrawal in accordance with Article 16(m) of the Consumer Rights Directive
You acknowledge that by activating the service, the right of withdrawal has expired and refunds are no longer possible.

4. Free Trial Period

We offer new users a free trial period allowing you to test the service without obligation before proceeding to a paid subscription.
4.1 Trial Period Conditions
• The free trial period includes up to 50 invoices per month
• No credit card or payment details required
• Full access to basic functionality
• Cancellation possible at any time without cost
4.2 Transition to Paid Subscription
After the free period, you may transition to a paid subscription. By making this transition, you confirm that you:
• Have sufficient knowledge of the service
• Consider the service suitable for your business
• Voluntarily and knowingly waive your right of withdrawal upon activation

5. Refund Policy

5.1 No Refunds for Digital Services
Given the nature of our digital services and the fact that the service is fully available immediately after payment, we offer no refunds for:
• Subscription fees already paid
• Services already delivered/used
• Automatic subscription renewals
• Upgrades or additional services
5.2 Technical Problems
In case of serious technical problems that substantially hinder service delivery and cannot be resolved within 14 business days, you may be eligible for:
• A pro-rata refund for the non-delivered period, OR
• A proportional extension of your subscription
This is at the discretion of Winkel Factuur and requires written evidence of the technical problems.
5.3 Double Payment
In case of demonstrable double payment, the extra payment will be refunded within 14 business days.

6. Cancellation and Termination

6.1 Cancellation by Customer
You can cancel your subscription at any time via:
• Your account settings in the dashboard
• Email to [email protected]
• Written request
6.2 Cancellation Effective Date
• Cancellation takes effect at the end of the current billing period
• Already paid amounts will not be refunded
• You retain access to the service until the end of the paid period
6.3 Automatic Renewal
Subscriptions are automatically renewed unless you cancel at least 48 hours before the end of the billing period.
6.4 No Refund for Early Cancellation
If you cancel mid-billing period, there is no pro-rata refund. However, you will have access to the service until the end of the already paid period.

7. Suspension and Termination by Winkel Factuur

We reserve the right to suspend or terminate your account in case of:
• Violation of our Terms and Conditions
• Fraudulent use or suspicious activities
• Non-payment or chargeback of payments
• Service abuse (spam, illegal activities)
• Demonstrable improper use of free limits
7.1 No Refund Upon Termination
Upon termination by Winkel Factuur for the above reasons, there is no refund of already paid amounts.
7.2 Data Retention
After termination, your data is retained in accordance with our Privacy Policy. Download of your invoice data is possible for 30 days after termination.

8. Exceptions and Goodwill Policy

Although we are not legally obliged to provide refunds for digital services, we may in exceptional cases consider a partial refund as a gesture of goodwill for:
• Prolonged technical problems (>14 days) that cannot be resolved
• Demonstrable serious misunderstandings about the service
• Medical emergencies or death (if proven with documents)
Conditions for Goodwill
• Written request within 7 days of problem
• Detailed description and evidence
• Minimal use of service (<5% of available limits)
• Good faith shown in attempting to resolve the issue
Goodwill requests are evaluated individually. Decisions are final and not binding for future cases.

9. Refund Request Procedure

For a refund request (only for technical problems or double payment):
Step 1: Written Request

• Your full name and account details
• Invoice/transaction number
• Detailed description of the problem
• Evidence (screenshots, error messages)
• Desired solution
Step 2: Evaluation
• We will evaluate your request within 14 business days
• We may request additional information
• You will receive a written decision

• Refund to original payment method
• Processing time: 14-30 business days
• Any transaction fees are at your expense

10. Dispute Resolution

11. Payment Methods and Chargebacks

11.1 Accepted Payment Methods
We accept payments via:

• Credit card (Visa, MasterCard)
• Direct debit (SEPA)
• Other methods supported by iyzico
11.2 Chargebacks
Unauthorized chargebacks are considered a violation of our terms:
• Your account will be immediately suspended
• Chargeback fees (€25-50) will be charged
• No access to service until debt is paid
• Possible legal action in case of fraud
11.3 Correct Procedure
Always contact us first in case of:
• Unrecognized transactions
• Technical problems
• Billing questions
We resolve 95% of problems within 48 hours without chargeback.

12. Changes to this Policy

We reserve the right to modify this policy. Changes will be:
• Announced at least 30 days in advance by email
• Published on our website with effective date
• Applicable to new transactions after the effective date
Continued use of the service after changes means acceptance of the new policy.
